Court is Now in Session: Lazurit, Admiralty Shipyards, and "Igor Belousov" Sub Rescue Ship

On October 24, 2005, the RF Ministry of Defense signed a contract (702/05/28/KN/0028 - "Creation of New-Generation Rescue Ship") with Admiralty Shipyards for the construction of Belousov submarine rescue ship "Igor Belousov". To support that effort, on May 18, 2006, Admiralty Shipyards signed a contract (#2618-06 - "Development of Working Design Documentation for Deep-Water Diver System for Project 21300 Rescue Ship (Delfin-GVK) and Production and Testing of Prototype Component Equipment") with Lazurit Central Design Bureau.

On November 9, 2011, the RF Ministry of Defense and Admiralty Shipyards signed an agreement (N/1/5/0609/D21-11-DGOZ) by which the previous state contract (702/05/28/KN/0028) was cancelled. On December 6, 2011, Admiralty Shipyards informed Lazurit that their contract (#2618-06) had been cancelled as a result.

On January 31, 2012, the RF Ministry of Defense issued a decision (#235/1/5/744) under which Admiralty Shipyards and the 208th MOD Representation Office were to determine the actual costs incurred by Lazurit under the cancelled contract (#2618-06). In its letter (#26-PDO-1092) to Admiralty Shipyards on April 6, 2012, Lazurit provided documentation of completed work under the contract totalling RUB 836,903,813, to include work completed by Italian sub-contractor DRASS Galeazzi.

After reviewing the documents, Admiralty Shipyards established that it had already paid Lazurit an advance of RUB 660,542,424, but that Lazurit had only spent RUB 472,988,767 at the time the contract had been cancelled [difference = RUB 187,553,657]. Admiralty Shipyards also determined it would not pay for the stages of the contract that were not completed, as the equipment had not been delivered and as some of the work stages (3.1, 3.2, 5, and 6.1) and related expenses linked to the contract had not been approved by Admiralty Shipyards.

In 2012, Lazurit filed a suit (Case #A56-24829/2012) against Admiralty Shipyards for payment of work [expenses (RUB 836,903,813) - advance (RUB 660,542,424) = RUB 176,361,389] completed under the contract. In its July 2013 ruling, the Arbitration Court of St. Petersburg and Leningrad Oblast ruled in favor of Lazurit, and Admiralty Shipyards was ordered to pay. Following several appeals that ended with a September 2013 decision in favor of Lazurit, Admiralty Shipyards finally paid Lazurit on December 25, 2013.

Citing unfair business practices, on April 28, 2014, Lazurit filed a new suit (Case #A56-26894/2014) with with Arbitration Court of St. Petersburg and Leningrad Oblast against Admiralty Shipyards. In its suit, Lazurit sought to receive (a) RUB 29,763,836 in penalties for late payment of expenses incurred by Lazurit between April 2012 and December 2013, (b) RUB 11,147,911 in lost revenue due to currency exchange rate variations, and (c) RUB 72,635,154 in lost profits [total = RUB 113,546,901]. By the trial date, however, those numbers had been corrected to (a) RUB 29,521,064 in penalties for late payment of expenses incurred by Lazurit between April 2012 and December 2013, (b) RUB 11,147,911 in lost revenue due to currency exchange rate variations, (c) RUB 58,941,791 in lost profits for work under Supplementary Agreement #13, and (d) in lost profits for work under Supplementary Agreement #14 [total = RUB 113,304,129].

Admiralty Shipyards argued that:

  • according to previous court decisions (A43-3989/2012 and A56-24829/2012), the RF Ministry of Defense's cancellation of the original contract (702/05/28/KN/0028) naturally led to the cancellation of the sub-contract (#2618-06) with Lazurit.
  • the RUB 176,361,389 earlier paid to Lazurit was based on Lazurit's own calculations, which included RUB 71,445,984 in profits for Lazurit.
  • Supplementary Agreement #14 was not legal, as it was not signed by Admiralty Shipyards or the 175th or 208th MOD Representation Offices.
  • Lazurit did not prove the necessary conditions to seek lost revenue due to currency exchange rate variations because the contract between Admiralty Shipyards and Lazurit (#2618-06) stated rubles as the contract's currency, and because Admiralty Shipyards was not a party to the contract (РН1/2009, dated December 22, 2009) signed between Lazurit and DRASS Galeazzi.
  • it should not have had to pay the RUB 176,361,389 required by the court's previous ruling (A56-24829/2012), as Lazurit never provided proof that the RF Ministry fo Defense had paid Admiralty Shipyards that amount of money for work performed by Lazurit.

In reviewing the materials provided by both parties, the court:

  • found that Admiralty Shipyards took 20 months to pay Lazurit for expenses incurred under the contract. In accordance with Higher Arbitration Court Letter #51 (January 24, 2000), payment by a general contractor for work by a sub-contractor must be paid regardless of whether the customer has paid the general contractor. Thus, Admiralty Shipyards [general contractor] should have paid Lazurit [sub-contractor] within one week of Lazurit's April 2012 submission of calculated expenses under the contract.
  • lowered Admiralty Shipyard's penalties to RUB 24,600,887 after determining Lazurit had miscalculated them.
  • denied Lazurit's claims for lost revenue due to currency exchange rate variations and lost profits for work under Supplementary Agreements #13 and #14.

On December 1, 2014, the court ordered Admiralty Shipyards to pay Lazurit RUB 24,600,887 in penalties and RUB 43,425 in state taxes.

On January 30, 2015, Admiralty Shipyards filed an appeal with the 13th Arbitration Appeals Court, which will begin hearing the case on March 2.

The main lesson of World War II for Russia was that you must stay sharp and address defense issues systematically, president of the Academy of Military Sciences Makhmut Gareyev told Interfax-AVN.

"The main lesson, in my view, is that the government must address reinforcing our defense consistently and not zig-zag from side to side as happened in 2008-2011. Back then, without any specific scientific basis, we eliminated entire branches of the Armed Forces and military districts, we deactivated tank and joint service commands, and we 'optimized' dozens of military academies, military schools and institutes," Gareyev said.

He noted that today "the military-political situation around Russia is changing dramatically and at nearly lightning speed."

"They are trying to surround us with NATO and U.S. bases and with American BMD. The conflict in southeastern Ukraine could soon degenerate into a large-scale war. Under these difficult conditions, we need not only to focus our military and scientific capacity on fulfilling the 2020 State Armaments Program and stepping up control and personal responsibility for on-time deliveries of new hardware and weapons to the military forces, but also on using modern forms and methods of planning to organize the country's defense," the general observed.

"Incidentally, as far back as five years ago I spoke several times from various podiums about the geopolitical pressure on Russia, primarily from the U.S. Unfortunately, my forewarnings were not heeded even by other veteran military leaders," the expert added.

According to him, "challenges and threats to Russia today are made not only through military means, but also through political, information, and economic means, as well as various sanctions, which each of us has already felt."

"Under these conditions, I feel that it is appropriate that we develop a state plan for strategic deterrence of the most dangerous threats," the general said.

In his opinion, today the status of the defense minister needs to be raised in view of the increased significance of coordination of military and non-military defensive resources at the state level.

"Specifically, to endow the Russian Minister of Defense with powers of a Deputy Supreme Commander-in-Chief not only in wartime, but in peacetime, as well. And to increase the role of the Armed Forces General Staff for more effective coordination in resolving military issues with the country's power structures," the general said.

"An extremely dangerous situation has now developed around Russia. We cannot even dismiss the possibility, under specific conditions, of an outbreak of large-scale military actions. Therefore, we also need to clearly decide on a mobilization aspect, which until recently was the weakest item in our defense system. From the view of ensuring Russia's security, we have never been (perhaps only in the pre-war years) in such a difficult position, in a circle of foes. In order to not find ourselves in the position that occurred in 1941, we have to continuously conduct realistic threat assessments and be concerned about reinforcing our military capabilities and the capabilities of the state," the general said.

Salyut Beats MOD in “Vitse-Admiral Kulakov” Case

On April 12, 2002, the Russian MOD (Naval Directorate of the Chief of Shipbuilding, Weapons, and Weapons Maintenance) signed a contract (#713/03/28/KN/0321-02) with Salyut Scientific Production Enterprise under which Salyut was to complete experimental design work “Rybets”. On September 25, 2010, the sides signed a Supplementary Agreement (#704/28/3/REV/D018/0115-10) which further defined certain stages and sub-stages of the state contract, to include:

Stage 9 – confirmation of the working design documentation in order to set up serial production of the 5N-30N; cost of this stage: RUB 1,672,654; work commencement: November 6, 2010; work conclusion: November 25, 2010

Stage 16 – confirmation of the working design documentation in order to set up serial production of the UN-30112; cost of this stage: RUB 1,670,858; work commencement: November 6, 2010; work conclusion: November 25, 2010

Stage 17 – confirmation of the working design documentation in order to set up serial production of the 511-3011; cost of this stage: RUB 1,170,858; work commencement: November 6, 2010; work conclusion: November 25, 2010

Prototypes of the 5P-30N (Fregat-N) and 5P-30N2 (Fregat-N2) radars, as well as the 5P-30P radar data processing system, were originally scheduled to be tested on Udaloy I-class destroyer “Vitse-Admiral Kulakov” in March-April 2010; however, due to an unanticipated issue with the ship’s hull that required dock repairs, the testing was delayed until November 25, 2010. Initial testing was completed on October 15, 2010, and the prototypes were handed over to the MOD for state testing on the same date. However, according to RF Navy Commander-in-Chief Decision #721/ОНК/5538  - “Preparing Project 1155 Large ASW Ship “Vitse-Admiral Kulakov” to Join the Permanent Ready Forces and Transfer to Its Homeport” (dated September 22, 2010), the destroyer was accepted before state testing and acceptance of the 5P-30N, 5P-30N2, and 5P-30P could be completed.

Both sides signed a joint decision on January 31, 2011, that reiterated that initial testing of the prototype equipment had been completed, but due to the destroyer’s transfer from the Baltic Fleet to the Northern Fleet, state testing could not be completed earlier than 2011. According to the decision, state testing would be finished during the second quarter of 2011, and all actions related to preparing the prototypes for serial production would be completed in October 2011. Based on Northern Fleet leadership input, a decision was made by the state acceptance committee to conduct state testing of the prototype equipment by September 30, 2011.

The end date was further pushed back until December 1, 2011, due to the requirement for the destroyer to undergo a 41-day shipyard repair period between October 1 and November 10. The at-sea test date was set for November 16. After several more delays, the destroyer finally got underway for testing – but without any industry personnel on board, thus preventing the completion of state testing. Salyut complained to the Northern Fleet commander, who in turn ordered the ship back to sea on December 6 to perform the state testing. Several fleet aircraft (IL-20 Coot A, IL-38 May, and KA-27 Helix) provided support for that day’s testing. Based on the first day's results, everyone agreed the prototype equipment was ready for a live missile launch against a P-120RM target missile the next day. However, on December 7, the ship’s 3R-95/Kinzhal (SA-N-9/Gauntlet) surface-to-air missile suffered a malfunction that the crew could not fix. Since, without the SA-N-9, the ship would be unable to protect itself in the event the P-120RM target missile veered off course, a decision was made to suspend state testing and return to port. The ship returned to port on December 8, and fleet personnel began removing the ship’s weapons on December 9 in advance of placing the destroyer in a dry dock. The Northern Fleet agreed that the next time the ship would be available to perform state testing of the prototype equipment would be February 2012.

On November 27, 2013, the MOD filed a suit against Salyut for failure to full its contractual obligations by the stated deadline. In its suit, the MOD sought RUB 1,561,589 in fines for non-fulfillment of the contract.

On February 20, 2014, the Arbitration Court of Moscow issued a ruling in the case (#A40-169577/2013) in favor of Salyut, stating that Salyut could not be blamed for the MOD’s inability to provide the proper equipment (i.e., operable destroyer with operable SA-N-9) within the stated time frame.

Not satisfied with the verdict, the MOD filed an appeal with the 9th Arbitration Appellate Court on April 29, 2014. The court upheld the lower court’s decision on June 11.

On August 14, the MOD filed a final appeal with the Arbitration Court of the Moscow District, which similarly dismissed the case in line with the two previous decisions.

The Central Naval Portal (CNP) has learned that an accident involving an engine on the new frigate "Admiral Flota Gorshkov", built at Northern Shipyard for the Russian Navy, was caused by the failure of a control system.

A CNP journalist learned from the Saturn Scientific Production Association, which is performing a survey and subsequent repairs of the engine, that the primary theory behind the failure was abnormal performance of the control system which led to the engine being flooded with fuel, after which it caught fire.

The fact that the engine on the Russian Project 22350 frigate "Admiral Gorshkov" required repairs was reported on December 29, 2014. On December 17, Northern Shipyard announced it was accepting bids for a 24-million-ruble contract for disassembling and surveying the ship's gas turbine engine.

According to a Saturn official, an assessment of the loss and inspection of the damaged engine pieces will last until March 2015 as company workers are not familiar with the engine's design. It is too early to announce when repairs will be completed and when fully operational engine pieces will be available.

The accident theory has been confirmed by another CNP source within the shipbuilding industry who has information about the accident. "The fuel pump did not shut off in time. There was a surge, and blades in the engine were damaged by the fire. The turbine has been removed and shipped to Rybinsk (location of Saturn Scientific Production Association - ed.) for repairs," the source said, noting that this occurred in September 2014.

Additionally, similar information has been reported by yet another knowledgeable shipbuilding industry source. He said that the control system failure could have been the result of a design error. "The turbine needs to undergo capital repairs; the blades were damaged by the fire. The problem was with the control system's performance. It was, most likely, a design error," he explained.

This opinion is shared by a Northern Shipyard employee. "The control system malfunctioned even though it functioned normally prior to this," the company specialist noted.

The design of the frigate engine's control system is Avrora Scientific Production Association Concern. Avrora informed CNP that the customer has not contacted the company regarding any complaints resulting from the mishap and pointed out that talking about the causes of the mishap can only be done after an official conclusion is made by experts.

Northern Shipyard's press office claims that there have been and currently are no problems with the ship or its equipment. "Our position is very simple. 'Gorshkov' completed the first phase of testing. And that's our position," stated the press office, adding that during the sea trials, the ship demonstrated specified numbers in accordance with technical specifications.

The fire-damaged M90FR gas turbine engine was developed and built at Saturn Scientific Production Association in cooperation with the Ukrainian company Zorya-MashProyekt. The Ukrainian company's press office told CNP that it had not heard about any problem with the Russian ship's engine and that no one had consulted the company regarding repairs.

Afterwards, CNP learned that the frigate's damaged engine was replaced with a duplicate engine from another ship of the same class - "Admiral Flota Kasatonov", which is also being built at Northern Shipyard. This was done in order to not delay factory sea trials of "Gorshkov".

"Admiral Flota Sovetskogo Soyuza Gorshkov" completed 30 days of factory sea trials between November 18 and December 26 last year. It has not been underway since.

Status of Kilo Transfers to Black Sea Fleet

Despite official claims that new Kilo-class (Project 636.3) submarines would begin arriving in the Black Sea Fleet in May-June 2015, the readiness of the first hull, named "Novorossiysk", is in question. According to one source, there may be problems with the submarine as evidenced by the lack of reporting of any activity by the submarine since it transferred to Polyarnyy in November 2014. The source indicated "something serious" occurred on the submarine before the New Year that will require its return to Admiralty Shipyards in the Baltic Sea this spring before it heads for the Black Sea.

The second unit of the new class, "Rostov-na-Donu", was commissioned into the Russian Navy on December 30. On January 8, a navy spokesman told reporters that the submarine crew was preparing to transfer to the Northern Fleet for deep-water testing of equipment and weapons. The submarine remains at Admiralty Shipyards as of today.

When President Putin visited Novorossiysk Naval Base in September 2014, he was informed by Black Sea Fleet commander Admiral Vitko that construction projects at the base to support new ships [and submarines] would not be completed until late 2016. And that date has been pushed back to sometime in 2017, according to a Southern Military District press release this month. A review of contracts announced in 2014 indicates a lot of work has yet to be completed. Seven contracts specifically linked to submarine basing in Novorossiysk have reported completion deadlines of between May 2015 and February 2016, with the majority of them being completed in August or later.

Despite this construction timeline, the first two new submarines can be temporarily based in Sevastopol, if needed. With regards to submarine battery recharging requirements, the converted Romeo-class submarine "PZS-50" (PZS = floating charging station) could be transferred to Novorossiysk on a temporary basis. "PZS-50" normally supports the fleet's sole Kilo submarine, "Alrosa"; however, that submarine's ongoing repairs will last through October 2015. This means "PZS-50" is free to support submarine basing requirements in Novorossiysk until that base's recharging station is completed in October, after which "PZS-50" would return to Sevastopol.
